Government Slashes Legal Uncertainty as Bappenas Designs New Economic Direction: Can the Jumbo Rp400 Trillion Credit Strategy Spur National Industry?

Executive Summary

The Indonesian government proposes removing the "state economic loss" element from the Corruption Eradication Law to create legal certainty and support the development of a global financial center. Simultaneously, Bank Indonesia is urging Bappenas to draft an integrated long-term development plan to strengthen the national manufacturing structure through Danantara's strategic role. Meanwhile, the planned distribution of Rp400 trillion in people's credit in 2027 is expected to focus on distribution quality and market certainty for MSMEs, rather than merely inflating credit ceilings..

The Indonesian government has proposed the elimination of the "state economic loss" norm stipulated in Article 2 of the Corruption Eradication Law (UU Tipikor). The Coordinating Minister for Law, Human Rights, Immigration, and Correction stated that this discourse aims to align national regulations with the United Nations Convention Against Corruption (UNCAC) standards and eliminate "rubber clauses" that trigger investment fears. This legal redefinition study was initiated by the National Economic Council (DEN) to provide solid legal certainty guarantees for business actors.

The Chairman of DEN emphasized that legal certainty is an absolute prerequisite for building the Indonesian International Financial Center (PFII) special economic zone and family office facilities. The government assesses that overly broad definitions of corruption frequently hinder the smooth execution of strategic development projects. Through this regulatory revamp, the government is optimistic that the national investment climate will become increasingly attractive to global investors. This solidifying legal certainty serves as the primary capital for monetary authorities and development planners in formulating a long-term economic direction.

The Governor of Bank Indonesia urged the Ministry of National Development Planning (Bappenas) to draft an integrated and sustainable long-term development plan. He emphasized that Indonesia requires a comprehensive economic strategy to avoid being easily shaken by global geopolitical dynamics and the rapid advancement of artificial intelligence technology. The monetary authority assesses that generating real-sector growth and providing employment requires close, consistent synergy among government agencies.

Furthermore, Bank Indonesia highlighted the importance of revitalizing the manufacturing base and downstreaming so that the national economy does not continue to rely on raw commodity exports. In this context, the investment body Danantara plays a key role as a locomotive to open access to potential projects and boost private investor confidence. This industrial transformation effort through integrated planning requires the support of accurately targeted financing facilities at the real business level.

The government has set a target of Rp400 trillion for people's credit distribution in 2027 to reach 28 million families across Indonesia. Although this ceiling is an increase of Rp53 trillion compared to the previous year, an economist from CORE Indonesia warned that this figure does not entirely represent fresh capital injections. A large portion of the budget allocation still stems from ongoing programs, such as the People's Business Credit (KUR) worth Rp300 trillion and housing finance worth Rp50 trillion.

CORE Indonesia advised the government to focus on the effectiveness of credit disbursements to the productive sector rather than merely inflating program capacities on paper. Currently, MSME credit growth remains sluggish at 2.7%, and MSME working capital credit actually contracted by 2.6% amidst an abundance of undisbursed loans. The government is urged to link credit distribution with guaranteed buyers (offtakers) and State-Owned Enterprise (SOE) supply chains so that business actors can maintain measurable and reliable cash flows.

The harmonization of corruption criminal law, the formulation of an integrated economic plan, and the revamping of people's credit schemes will positively impact the certainty of the business climate and financing access. For foreign investors and corporate players, legal certainty guarantees encourage bold capital expansion in the manufacturing and financial industries. Meanwhile, for MSME players and the broader public, ease of access to productive credit connected to industrial supply chains provides business sustainability guarantees and expands employment.

Ultimately, strengthening legal certainty through regulatory redefinition, Bappenas' integrated economic planning, and efficient people's credit distribution serve as the main pillars sustaining national economic growth. The government is recommended to immediately finalize the PFII technical rules, accelerate the drafting of the national manufacturing roadmap, and mandate business mentoring for MSME credit recipients. Business actors are advised to capitalize on investment opportunities in special financial zones and optimize SOE supply chain partnerships to strengthen sustainable business competitiveness.
