PT BDU faced a VAT taxable base (DPP) correction worth IDR 1.16 trillion regarding cigarette supplies at the distributor level. This conflict stems from the interpretation of the status of cigarette supplies, where the VAT has been collected at the manufacturer level (single-stage levy) using an effective rate based on the Retail Selling Price (HJE).
The Respondent argued that supplies at the distributor level are non-taxable VAT supplies because the tax burden was settled upstream. Conversely, the Taxpayer argued that cigarettes are Taxable Goods (BKP), meaning their supply is legally subject to VAT but not collected again to prevent double taxation. The Board of Judges ultimately ruled that, administratively, such supplies are indeed classified as non-taxable VAT in the VAT Return (SPT) reporting.
The implications of this decision confirm that even though the goods are BKP, specific government policies can alter the administrative treatment. For distributors, reporting under the "Non-Taxable VAT Supplies" column is a consequence of the regulations governing the procedures for collecting VAT on tobacco products.
