Legal certainty for tax withholding agents was tested in a significant dispute between PT BI and the Directorate General of Taxes (DGT). The dispute centered on the withholding of Income Tax Article 23 on rewards and incentives derived from the equalization of Sales Assist Fund expenses. A critical issue arose when the DGT disregarded Tax Exemption Certificates (SKB) held by the taxpayers' counterparts, claiming that the substantive requirements of Government Regulation 46/2013 were not met, despite the SKBs being officially issued by the relevant Tax Office.
PT BI argued that as a third party, they lack the authority to question the decision of the Head of the Tax Office who issued the SKBs to their vendors. Conversely, the Respondent insisted the correction was valid, asserting that the expenses in the profit and loss statement were taxable objects that had not been withheld. However, the Tax Court found that the Respondent committed a procedural error by aggregating an entire year’s worth of corrections into a single tax period (December), which unfairly inflated interest penalties.
In its resolution, the Tax Court emphasized that a Taxpayer cannot be held liable for an SKB issued by the tax authority itself. As long as the document is formally valid, the withholding agent is entitled to legal protection. The Court also stressed the importance of the Principle of Accuracy in public administration; the act of charging annual corrections to a single period was deemed inaccurate and legally unjustifiable.
The implications of this ruling are vital for national tax practices. It reinforces the Taxpayer's position that cost equalization must not be generalized without considering the specific timing of tax liability for each transaction. Furthermore, tax authorities are reminded to be more cautious in making administrative corrections to avoid violating the procedural rights of Taxpayers.
