Tax Force Majeure Victory: Building Employee Mess in Remote Plantation, Input VAT is Creditable, Not a Consumptive Cost!

Input VAT Credit Dispute on Palm Oil Plantation Support Facilities

The Input VAT (PM) dispute of Rp47,580,338.00 related to expenditures for building employee mess/housing, kiosks/warehouses, and gathering/outbound activities at the palm oil plantation site was a point of conflict regarding the interpretation of Article 9 paragraph (8) subparagraph (b) of the VAT Law.

Tax Authority's Position

The Tax Authority rejected the VAT credit, considering it a consumptive expenditure that lacked a direct relationship with the business activities (production, distribution, marketing, and management). The Tax Authority also maintained that the designation of the plantation location as a Remote Area (SKDT) via KEP-41/WPJ.19/2006 was only relevant for Income Tax (PPh) purposes, not VAT.

Tax Court Panel of Judges Ruling

The Panel of Judges annulled this correction, interpreting the direct relationship contextually and pragmatically under extreme operating conditions. The Panel deemed that these expenditures constituted essential infrastructure and were a force majeure requirement for sustaining production activities at the remote plantation location with minimal infrastructure.

Furthermore, the Panel legally linked the Tax Authority's recognition of the SKDT as an implicit acknowledgement that these costs were indeed directly related to the Taxpayer's business activities, as production operations could not proceed without them. Since these expenditures ultimately support the production of CPO and Kernel, which are subject to VAT, the Input VAT must be creditable, consistent with the correlative principle of Article 9 paragraph (2) of the VAT Law.

Legal Precedent

This decision sets an important precedent for companies operating in remote areas, suggesting that costs for supporting facilities can be deemed to have a direct relationship with business activities for VAT crediting purposes.
