VAT Correction Failed: Bonded Warehouse Wins Against DGT, DPTDB Proved Not a Substantive Requirement for Non-Collected VAT

Indonesian Tax Regulation stipulates that the submission of Taxable Goods (BKP) from a Bonded Warehouse (Gudang Berikat) to a Bonded Zone (Kawasan Berikat) is eligible for Non-Collected Value Added Tax (VAT), a crucial facility designed to support export-oriented industries. In a critical dispute ruled through Tax Court Decision Number PUT-002287.16/2019/PP/M.IIIA Tahun 2020, PT SI, acting as both the operator and entrepreneur of a Bonded Warehouse (PDGB), successfully challenged a correction on its VAT Tax Base (DPP) amounting to over IDR 19.9 billion. The dispute stemmed from a conflict in interpreting customs administrative rules versus substantive tax provisions. The core question addressed was whether a customs administrative violation (not listed in the DPTDB) can override the substantive right to Non-Collected VAT.

Substantive Tax Provisions vs. Customs Administrative Non-Compliance

The Directorate General of Taxes (DGT), acting as the Respondent, imposed a positive correction on the VAT DPP by asserting that the Petitioner violated Article 17 letter d of the Minister of Finance Regulation (PMK) Number 143/PMK.04/2011. The violation involved the delivery of BKP to three Bonded Zone customers whose names were not listed in the Distribution Target Company List (DPTDB) within PT SI's Bonded Warehouse permit. The DGT argued that this administrative customs non-compliance directly nullified the right to the Non-Collected VAT facility, hence the transaction should be treated as a regular delivery within the Customs Area where VAT is self-collected and due. PT SI, conversely, argued that the customers were verifiably Bonded Zone Entrepreneurs (PDKB) and that the delivery from a Bonded Warehouse to a Bonded Zone is guaranteed under Article 16B of the VAT Law and Article 12 of PMK 143/2011. PT SI maintained that DPTDB is merely a customs administrative requirement which cannot override the substantive VAT status.

Tax Court Panel Ruling and Rationale

The Tax Court Panel explicitly separated customs and tax issues. The Panel affirmed that non-compliance with the customs administrative obligation (DPTDB) is an issue falling under the surveillance authority of the Directorate General of Customs and Excise and does not automatically void the Non-Collected VAT treatment stipulated by the VAT Law and Government Regulations. The Non-Collected VAT facility is inherent to the nature of the transaction and the status of the transacting parties—delivery from one Bonded Stockpile to another Bonded Stockpile. Since the Petitioner could substantiate the PDKB status of its customers and had utilized the correct export declaration document (BC 2.7), the Panel concluded that the DGT’s correction lacked a strong legal basis and annulled the correction.

Legal Implications and Precedent

This decision provides significant legal certainty for industry players operating in bonded areas. The implication of this ruling clarifies that administrative formalities governed by the customs regime cannot override the substance of VAT treatment defined under the tax regime. This decision sets an important precedent that other Taxpayers can use to defend against VAT corrections based solely on customs administrative violations, provided the substantive tax requirements are met. The PT SI case highlights the necessity of focusing on substantive tax requirements when engaging in disputes.

The PT SI case affirms that fulfilling the substantive requirement—delivery of BKP from a Bonded Warehouse to a Bonded Zone—is superior to customs administrative failure in determining the VAT treatment. Taxpayers must ensure that all relevant VAT documentation and the correct customs forms (BC 2.7) are utilized, while simultaneously striving to maintain customs administrative compliance to prevent potential penalties in the Customs and Excise area.
