IDR 25 Billion Input Tax Credit Forfeited! Tax Court Rejects HTI Taxpayer's Appeal Due to Late Commercial Production

The application of the time limit for crediting Input Tax (PM) for Taxable Entrepreneurs (PKP) who have not yet commenced commercial production, as stipulated in Article 9 paragraph (6a) of the PPN Law juncto Article 56 of PMK 18/PMK.03/2021, has once again emerged as a critical issue in long-term sector tax litigation. PT PBA, an Industrial Timber Plantation (HTI) company with a prolonged production cycle, was forced to accept the adverse judgment where a correction of Input Tax amounting to IDR 25.6 billion was upheld by the Tax Court Panel. The rejection was based on the failure to meet the deadline for the delivery of self-produced Taxable Goods (BKP) within 5 (five) years from the initial crediting of the Input Tax. The central dispute revolves around the differing regulatory interpretations of the concept of "self-produced BKP" between core cultivation activities and timber derived from the statutorily regulated land preparation phase.

Dispute over Core Cultivation vs. Land Clearing Timber Sales

The conflict arose when the Respondent (Directorate General of Taxes/DJP) rejected all Input Tax credited since March 2018. The argument presented was that the HTI's primary product, namely cultivated Acacia and Eucalyptus timber, could only be commercially delivered outside the 5-year limit. The DJP strictly underscored that the sale of natural timber (forest timber) resulting from Land Preparation activities (land clearing) cannot be categorized as the delivery of "self-produced BKP" as intended by Article 9 paragraph (6a) of the PPN Law, because this activity was deemed not directly related to the core business of plant cultivation. This correction was reinforced by the fact that the planting process could proceed regardless of the utilization of non-cultivated forest products.

The Petitioner's Argument on Integrated Business Operations

Conversely, the Petitioner (PT PBA) firmly maintained that the Timber Forest Product Utilization Business Permit for Industrial Timber Plantations (IUPHHK-HTI) constitutes a legally integrated series of activities. The Petitioner referenced technical regulations from the Ministry of Environment and Forestry (KLHK), which explicitly states that Land Preparation "includes the utilization of its forest products." Consequently, the sale of natural timber realized between 2019 and 2021 was a legitimate BKP delivery, proving the Taxpayer had commenced production within the 5-year limit. This meant the Input Tax arising from initial investments (fertilizer, fuel, land clearing services) was validly credited.

Tax Court Panel Ruling and Legal Rationale

Addressing these two contrasting arguments, the Tax Court Panel in its Decision Number PUT-002389.16/2024/PP/M.IXA Tahun 2025 opted to rely on the fact admitted by the Petitioner: the non-delivery of the main product (cultivated Acacia and Eucalyptus timber) within the 5-year period. The Panel leaned toward interpreting the 5-year time limit as a strict formal prerequisite that must be satisfied by the ultimate product of the business activity. Given the failure to deliver cultivated timber within the permitted period, the Panel deemed the Petitioner failed to meet the crediting requirements, thereby upholding the correction.

Industry Implications and Legal Precedent

The implications of this decision are highly significant for the HTI sector and other industries characterized by a long gestation period. The ruling reinforces the DJP's interpretation that Input Tax credited during the pre-production phase must be justified by the delivery of the BKP resulting from that Input Tax investment—the directly related primary product. For Taxpayers, this decision serves as a powerful precedent, emphasizing the necessity of aligning the integrated business interpretation (forestry law) with the tax interpretation, or at minimum ensuring the sale of the primary product, however small, occurs within the 5-year window to secure the Input Tax crediting.
