VAT disputes regarding inter-Bonded Zone transfers often hinge on the taxpayer's ability to present physical formal documents, specifically the BC 2.7 form, during tax audits. In this landmark case, the Respondent issued a positive correction of the VAT Base (DPP) amounting to IDR 554,310,008, asserting that PT TI failed to substantiate its entitlement to VAT non-collection facilities due to the absence of original documentation.

The Conflict Over Document Destruction in Force Majeure and Secondary Evidence

The conflict ignited when tax authorities reclassified the transfers from "VAT Not Collected" to "Self-Collected VAT." The correction was based on formal non-compliance with Directorate General of Customs and Excise Regulation No. P-22/BC/2009, as PT TI could only provide photocopies of BC 2.7 forms, claiming the originals were destroyed in a major fire in April 2017. PT TI contested this, arguing that the economic substance of the delivery to another Bonded Zone entity (PT PET) remained valid and was supported by extensive secondary evidence.

The Board of Judges emphasized in their legal considerations that while the BC 2.7 form is the primary formal evidence, its absence does not automatically void tax facility rights as long as the flow of goods and the tax status of the parties are verifiable. The Judges conducted an in-depth examination of supporting evidence, including Invoices, Packing Lists, Delivery Orders, and the buyer's Bonded Zone license. Consequently, the Court was convinced that the transaction substantially met the criteria for VAT non-collection facilities under Government Regulation No. 32 of 2009.

Conversely, the Input Tax Claim Fails Due to Discrepancies in Cash Flow Records

Conversely, the Court ruled against PT TI regarding the Input Tax dispute valued at IDR 29,945,560. Although PT TI argued they had settled the payments and invoked the joint liability principle under Government Regulation No. 1 of 2012, the Judges upheld the Respondent's correction. The decision was based on a discrepancy between the cash flow recorded in bank statements and the values stated on the Tax Invoices, rendering the proof of payment unreliable.

This ruling reinforces that in the Indonesian tax system, while "substance over form" may be accepted to preserve tax facilities (as seen in the Output Tax dispute), absolute accuracy in cash flow verification is mandatory for Input Tax crediting.
