Service Transactions to Singapore: Why Was a Negative Correction Upheld by the Judges?

Tax Dispute: Article 26 Income Tax Reporting on Foreign Marketing Commissions

The payment of marketing service commissions to foreign tax subjects often becomes a gray area in PPh Article 26 reporting. In the PT JEK dispute, a unique situation arose where the Respondent issued a negative correction to the Tax Base (DPP) for marketing services paid to TP Pte Ltd in Singapore. The Respondent argued that because the transaction did not meet the criteria for taxation in Indonesia according to the Tax Treaty (P3B), the transaction value should not have been reported in the PPh Article 26 Monthly Tax Return at the branch level.

Administrative Compliance Viewpoint of the Petitioner

The Petitioner held a different view regarding administrative compliance. The Petitioner argued that all transactions with foreign parties, even those with a 0% rate due to Tax Treaty protection, must still be included in the Monthly Tax Return as part of decentralized administrative reporting obligations. The Petitioner feared that removing the DPP would be seen as non-compliance in documenting the use of Tax Treaty facilities (DGT/SKD) at the relevant tax office.

Legal Considerations of the Panel of Judges

In its legal considerations, the Panel of Judges focused on the substance of taxing rights under Article 7 of the Indonesia-Singapore Tax Treaty concerning business profits. Since Taiko Plantation did not have a Permanent Establishment (BUT) in Indonesia, the taxing rights over the business profits from marketing services rested entirely with Singapore. The Panel concluded that the Respondent's negative correction was materially correct because Indonesia indeed lacked the right to tax the transaction, meaning the DPP reported by the Petitioner had to be nullified.

Implications and Recommendations for Tax Practitioners

This case underscores the importance of understanding the legal hierarchy between domestic rules and Tax Treaties (Lex Specialis). For Taxpayers, although the intent to report all transactions is for transparency, legally reporting a DPP for transactions that are not tax objects in Indonesia can trigger administrative corrections. Recommendations for tax practitioners include ensuring SKD/DGT verification is done promptly to mitigate the risk of interpretational disputes over international taxing rights.
