VAT Appeal Denied: When Input Tax is Deemed Invalid by the Tax Court

Tax Court Decision Number PUT-005821.16/2022/PP/M.XVB Year 2025: Formal and Material Requirement Fulfillments of Tax Invoices for PT RMI

The principle of Input Tax creditability regulated in Law Number 42 of 2009 concerning VAT was once again challenged in Tax Court Decision Number PUT-005821.16/2022/PP/M.XVB Tahun 2025, where the Panel of Judges rejected the taxpayer's appeal against the Value Added Tax correction for the January 2019 Tax Period, underscoring the necessity of fulfilling both formal and material requirements of the Tax Invoice for crediting purposes. This case involves PT RMI, which filed an appeal against the Underpaid Tax Assessment Letter (SKPKB) for VAT, with the main dispute centered on the Input VAT correction deemed non-creditable by the Director General of Taxes (DJP).

The Core Conflict: Formal Defect and Substantial Validity of Input VAT

The core conflict in this dispute originated from the DJP's action of correcting the Input VAT that the Taxpayer had credited. The DJP, as the Respondent, based its correction on Article 9 paragraph (8) of the VAT Law, which stipulates the exceptions for crediting Input VAT. The DJP's argument indicated a defect in the Tax Invoice, either formally (e.g., incomplete filling or late reporting) or substantially (e.g., the transaction’s validity was questioned, or it was unrelated to the taxable supply of Taxable Goods/Services). Conversely, the Taxpayer insisted that the Input VAT was real, directly related to the supply of Taxable Goods (BKP) and Taxable Services (JKP) subject to VAT, and had complied with all applicable tax provisions.

Legal Resolution: Burden of Proof and the Panel's Determination

The Tax Court Panel proceeded to the resolution stage by examining the evidence presented by both parties. In the context of tax litigation, the Taxpayer bears the burden of proof to overturn the DJP's correction. The Panel's legal opinion concluded that the Appellant failed to provide sufficiently convincing evidence to prove the validity of the disputed Input VAT. The failure to present strong supporting documentation or the presence of formal non-compliance indicators in the Tax Invoice led the Panel to believe that the DJP's correction was correct and based on law.

Impact and Analysis: Practical Compliance Implications for Corporate Taxpayers

The impact of this decision carries serious implications for other Taxpayers operating in Indonesia. This ruling sets an important precedent emphasizing that before the Tax Court, compliance must be proven with solid and credible documentation. Failure to perfectly manage Tax Invoice administration, even for a relatively small dispute value as in this case, can result in the rejection of the appeal.

In conclusion, the rejection of the appeal in this PPN-B1 case affirms that Input VAT administration is not merely a formality. Taxpayers are obliged to ensure every Tax Invoice is not only valid within the e-Faktur system but also supported by strong transaction substance, mitigating the risk of corrections that lead to costly and time-consuming litigation disputes.
