VAT disputes within Joint Operation (KSO) schemes often become entangled in the debate between contractual administrative formalities and the economic reality on the ground. The case of PT DR serves as a significant precedent regarding the application of the substance over form principle in Indonesian tax law. The conflict was triggered by the Defendant's recharacterization, which deemed that the provision of services to PT PLN should have been collected by the KSO as an independent entity, rather than directly by the KSO members using the collector's tax invoice code.
The Defendant maintained that because the contracts were legally signed by the KSO, the VAT obligation resided with the KSO entity in accordance with Government Regulation No. 1 of 2012. However, PT DR proved that the KSO was non-administrative in nature, where payments were made directly to each member without a joint bank account. The Board of Judges issued a progressive ruling, stating that since the VAT had clearly been collected by PLN and remitted to the state treasury, the aspect of justice must prevail. This decision affirms that tax administration must not ignore the substantial fact that the tax has been owed and paid, thereby avoiding legal injustice for compliant taxpayers.
