The Director General of Taxes (DGT) disallowed PT BD's Input Tax credit amounting to IDR 34,850,492.00, citing formal violations related to the Tax Invoice Serial Number (NSFP). This dispute centers on the interpretation of Article 13 paragraphs (5) and (9) of the VAT Law and PER-24/PJ/2012, where the Respondent deemed Tax Invoices issued prior to the NSFP allotment date as "Incomplete Tax Invoices" that are non-creditable.

The Respondent insisted that NSFP used outside the allocated range or before the official allotment date is legally flawed. In its resolution, the Board of Judges stated that formally, the Tax Invoices fulfilled the requirements of Article 13 paragraph (5) of the VAT Law. The Board emphasized that a buyer has no authority to monitor when a seller requests or receives their NSFP allotment from the DGT. As long as the transaction is genuine (material substance is met) and VAT was collected by the seller, the Input Tax credit is legally valid.
