PT KI Tax Dispute: PPh Article 26 Tax Base Correction via Cost Equalization Techniques

This dispute centers on the correction of the PPh Article 26 tax base amounting to IDR 183,456,860, which the Directorate General of Taxes (DGT) determined through cost equalization techniques. During the audit, the Respondent identified discrepancies between the costs recorded in the financial statements and the objects reported in the Tax Returns, specifically within the Miscellaneous and Accuservice Group accounts. The DGT argued that these differences constituted unreported taxable objects because the Taxpayer allegedly failed to provide sufficient physical evidence of the transactions.

Applicant's Rebuttal: Fundamental Flaws in Audit Logic, Double Counting, and Forex Fluctuations

However, PT KI, as the Applicant, presented a robust rebuttal, arguing that the Respondent’s audit logic was fundamentally flawed. The Applicant explained that the Accuservice Group account is a balance sheet (liability) account containing cost entries that were already reflected in the Miscellaneous expense account. Correcting both accounts without in-depth tracing resulted in "double counting" of the same taxable object. Furthermore, the Applicant demonstrated that part of the discrepancy originated from foreign exchange rate fluctuations and accounting rounding, which do not constitute taxable objects.

Judicial Considerations: Proper Bookkeeping Under KUP Law and the Limits of Mathematical Equalization

The Board of Judges emphasized in their legal consideration that since the Applicant maintained proper bookkeeping as per Article 28 of the KUP Law and remained cooperative during the audit, the burden of proof to justify the tax correction lies with the Respondent, pursuant to Article 12 paragraph (3) of the KUP Law. The Judges observed that the Respondent failed to conduct adequate transaction tracing and relied solely on mathematical equalization. The Court ruled that equalization results are merely preliminary indicators and not absolute proof of taxable objects unless supported by concrete transaction evidence.

The implication of this ruling is vital for Taxpayers: maintaining meticulous bookkeeping and comprehensive supporting documents is the primary defense against corrections derived from equalization. This decision underscores that the DGT cannot unilaterally determine tax liabilities based on numerical discrepancies without considering the substance of the transactions and the accrual accounting principles followed by the Taxpayer. Consequently, the Board of Judges annulled the Respondent's entire correction due to a lack of solid evidentiary basis.
