The Board of Judges, in their legal considerations, gave significant weight to the operational facts of the industry. The Judges ruled that the Comparable Uncontrolled Price (CUP) method adopted by the Taxpayer, referencing daily tender prices, was valid and reasonable. The Board opined that the Respondent failed to provide sufficient evidence of inconsistency or tax avoidance motives in the use of daily production prices. Due to the dynamic nature of commodity movements, pricing at the time of production was deemed to meet the arm's length principle criteria more accurately than merely referring to the administrative contract date.

Implications for the Agribusiness Sector

This decision carries significant implications for agribusiness players, particularly in strengthening transfer pricing documentation. PT SPS's victory reaffirms that the Tax Court recognizes business practices based on industry-specific characteristics, provided they can be consistently proven. For other Taxpayers, this case serves as a precedent that compliance with the arm's length principle does not always have to follow rigid administrative patterns but must align with daily market realities.

In conclusion, the Board of Judges overturned all of the Respondent's corrections and granted the Petitioner's appeal in its entirety. A valuable lesson from this case is the importance of synchronizing internal pricing policies with well-documented third-party market data (such as KPBN or Astra tenders). Success in this litigation heavily depended on the Taxpayer's ability to prove that the chosen method was the most appropriate in depicting market conditions at the time the transaction occurred.
