PT AM Faced Severe Legal Consequences Due to Inaccuracies in Formal Requirements

PT AM faced severe legal consequences due to inaccuracies in meeting the formal requirements for a lawsuit as stipulated in Article 40, paragraph (3) and Article 50 of the Tax Court Law. The dispute began when PT AM filed a lawsuit against the rejection of its application for the reduction of administrative interest sanctions under Article 8, paragraph (2a) of the KUP Law, which arose following an amended tax return (SPT) related to the Tax Amnesty program. However, during the trial, it was revealed that the decision number stated in the lawsuit differed from the decision intended by the Plaintiff, and the filing had exceeded the 30-day statutory limit from the date the decision was received.

The core of the conflict centered on the Plaintiff's attempt to change the object of the lawsuit mid-trial, citing a "clerical error." The Plaintiff argued that the intended object was KEP-06757, despite KEP-05232 being written in the document. Conversely, the Defendant (DGP) firmly rejected this argument, stating that changing the decision number constitutes a fundamental change to the material and formal substance of the lawsuit. Furthermore, the DGP proved that based on KEP-05232, the filing was 88 days late, rendering the lawsuit formally defective.

The Panel of Judges Legal Opinion on Certainty Regarding the Object

The Panel of Judges, in its legal opinion, emphasized that legal certainty regarding the object of a lawsuit is absolute. The Panel held that changing the decision number is not merely a matter of clarifying reasons or completeness (amendment of reasoning) but a change in the identity of the case, which is not permitted under tax procedural law. Since the lawsuit explicitly mentioned KEP-05232, the Panel used it as the reference point. Consequently, the Panel calculated the timeframe based on that decision and found that the 30-day deadline had long passed.

The implication of this ruling is crucial for Taxpayers: precision in identifying the contested decision and strict adherence to litigation timelines are final and binding. The "Inadmissible" (Niet Ontvankelijke Verklaard) verdict demonstrates that even if a Taxpayer has strong material arguments regarding tax amnesty sanctions, those rights are forfeited if formal procedures are not met with precision.
