Article 9, paragraph (1), letter e of the Income Tax Law explicitly states that expenses in the form of non-cash benefits (natura) are non-deductible unless provided in specific areas designated by the Director General of Taxes. In the PT BSP dispute, the Respondent issued a positive correction on employee housing depreciation, medical, electricity, and mess expenses totaling IDR 3,397,623,850.00.
The core conflict centered on the absence of a Remote Area Designation Decree (SK Penetapan Daerah Terpencil), a mandatory requirement for such expenses to be tax-deductible. The Petitioner documentation argued that these facilities were mandatory under the Manpower Law and essential for productivity in remote plantation locations.
However, the Board of Judges ruled that the formal administrative requirement under PMK 83/PMK.03/2009 and PER-51/PJ/2009 cannot be overlooked. Since the Petitioner admitted to not possessing the decree, the Board upheld the Respondent's correction. This reinforces that operational urgency does not supersede formal administrative obligations in Indonesian tax law.
