The core of this litigation focuses on the application of the Cost Plus Method (CPM) and the validity of external comparable selections used to test the fairness of contract manufacturing transactions with affiliates. The Respondent concluded that the Petitioner's mark-up was below the arm's length range, leading to a significant adjustment that drastically increased the fiscal net income.
