The dispute began when the Director General of Taxes (DGT) corrected the Input Tax of PT DATI, citing non-compliance with the formal requirements of Article 13 Paragraph (5) of the VAT Law and the absence of a direct relationship with business activities as per Article 13 Paragraph (8) letter b of the VAT Law. The DGT questioned the "Miscellaneous" (Lain-lain) description on the VAT Invoices and deemed certain operational expenses non-productive.
However, the Plaintiff successfully proved that the description referred to valid supporting invoices and all expenditures were part of legitimate company operational management.
The Panel of Judges emphasized that as long as the expenses relate to the entity's existence and operations, the Input Tax is creditable. This decision provides legal certainty that the interpretation of "direct relationship" must be viewed broadly to include overall business support activities.
