PT HEI Tax Dispute: Cost Equalization Adjustment on Cross-Border Technical Services under DTAA

The tax dispute between PT HEI and the tax authorities originated from a cost equalization adjustment regarding technical services provided by a South Korean vendor, which were initially classified as domestic Article 23 Income Tax objects. The Respondent adjusted the Tax Base (DPP) by IDR 919,758,015.00 based on the assumption that these services were utilized within the Indonesian customs area without proper tax withholding. However, the core of the conflict lies in the contradiction between domestic tax law and the taxing rights stipulated in the Indonesia-South Korea Double Taxation Avoidance Agreement (DTAA).

Core Conflict: Exclusive Residence Taxing Rights and DGT Form Compliance

The Applicant consistently refuted the adjustment, arguing that the payments were made to a South Korean tax resident with no Permanent Establishment (PE) in Indonesia. The Applicant strengthened its position by providing administrative documentation, specifically a valid Certificate of Domicile (CoD) or DGT Form, proving that exclusive taxing rights belong to the country of residence, provided the service "time test" criteria were not exceeded. Conversely, the Respondent maintained that the expenses were, in substance, subject to Indonesian withholding tax.

Judicial Resolution: DTAA as Lex Specialis and Fulfillment of PER-61/PJ/2009

In its resolution, the Tax Court Judges emphasized that the DTAA serves as lex specialis, which limits the taxing rights of the source country. Based on court facts and an examination of formal documents, the Judges found that all administrative requirements under PER-61/PJ/2009 had been fulfilled by the Applicant. Since the vendor was proven to be a domestic tax subject of South Korea and did not conduct activities through a PE in Indonesia, the Respondent's adjustment was declared to lack a strong legal basis.

The implications of this ruling provide legal certainty for Taxpayers, demonstrating that fulfilling formal DGT requirements is a crucial instrument in countering assessments on cross-border transactions.
