Tax Court Decision on VAT Status of Port Services of PT MS

The application of Value Added Tax (VAT) provisions on port services often triggers disputes, especially when corrections are made through flow testing and reconciliation between commercial turnover and Output VAT data. Tax Court Decision Number PUT-006212.16/2023/PP/M.XIIA Year 2025, which fully granted the Appeal request of Taxpayer PT MS, provides a crucial judicial affirmation regarding the status of port services that are an integral part of public water transport services. Within the context of VAT regulation, public water transport services, including those closely related to them, are excluded from VAT imposition, thereby becoming Non-Taxable Services (Non-JKP) or granted VAT exemption facilities.

Core Conflict on Output VAT Tax Base Correction

The core conflict in this case originates from the correction of the VAT Tax Base (DPP) on Output VAT amounting to more than IDR 107 billion conducted by the Respondent (Tax Authority). The Respondent based this correction on a discrepancy found during the reconciliation of the Taxpayer's commercial Profit and Loss Report turnover with the Output VAT data. In the Respondent's view, any discrepancy not documented in a Tax Invoice indicated a delivery of Taxable Services (JKP) on which VAT had not been levied, in accordance with the general provision of Article 4 section (1) letter c of the VAT Law.

Taxpayer's Rebuttal and VAT Exclusion on Water Transport

However, the Taxpayer strongly rebutted the correction. They argued that the corrected revenue, although recorded as turnover, entirely originated from the provision of port services integrated with shipping activities (public water transport) in the Riau region. The Taxpayer relied on the prevailing VAT legislation and implementing regulations (for example, Minister of Finance Regulation Number 80/PMK.03/2012 and Director General of Taxes Circular Letter No. SE-08/PJ.532/1999) which explicitly exclude VAT on public water transport services, including the supporting services integral to them.

Judicial Considerations Prioritizing Legal Substance

The Tax Court Panel, in its considerations, adopted a stance that prioritizes legal substance over the formality of data reconciliation. The Panel opined that port services are an inseparable part of public water transport services. By referring to the objective of the VAT facility, the Panel affirmed that the corrected revenue originated from the delivery of services that are statutorily excluded from VAT imposition. This decision explicitly rejects the Respondent's argument based solely on formal data discrepancies, and ruled that the Output VAT DPP correction imposed was without legal basis.

Significant Legal Precedent and Compliance Guidance

The Tax Court's decision to fully grant the Taxpayer's Appeal has significant implications. This ruling establishes a strong precedent for taxpayers in the port/shipping sector, showing that Output VAT corrections based merely on flow testing and reconciliation can be successfully challenged, provided the Taxpayer can substantially prove that the revenue originated from the delivery of VAT-excluded/exempt services. Taxpayers are advised to ensure a robust audit trail, separately record Non-Taxable Service turnover, and consistently argue by referencing the latest provisions on VAT exemption for public water transport services, such as those stipulated in Government Regulation Number 49 of 2022.
