The dispute over the classification of fixed assets has resurfaced in the latest ruling between PT AGN and the Directorate General of Taxes (DGT) regarding FPSO depreciation costs. The conflict originated when the tax authority reclassified the FPSO from Group 3 to Group 4, arguing that the vessel's weight exceeded 1,000 DWT. This classification is critical as it directly impacts the amount of depreciation expenses deductible for corporate income tax purposes.
The DGT's argument relied on a literal interpretation of PMK 96/2009, equating the FPSO to a specialized storage tanker. However, the Taxpayer successfully demonstrated in court that the KAS III FPSO lacks independent propulsion and functions as a permanently moored oil and gas processing unit. This fundamentally distinguishes the FPSO from cargo transport vessels intended under maritime transportation regulations.
The Tax Court Judges ultimately provided legal certainty by stating that since FPSOs are not explicitly mentioned in the PMK 96/2009 annex, the general rule must apply. According to Article 2 (1) of the regulation, assets not listed are automatically categorized into Group 3 with a 16-year useful life. This ruling reinforces that technical functional substance outweighs physical form in determining the useful life of assets for Indonesian tax purposes.
