Correction Decision of the Tax Court Regarding Administrative Clerical Error of PT AI

Referring to Article 66 of Law Number 14 of 2002 concerning the Tax Court (Tax Court Law), the Panel of Judges is authorized to perform a correction through a fast-track procedure to amend a clerical error that does not involve substantial dispute. The issue arose when the Supreme Court returned the Taxpayer’s (PT AI) Judicial Review (PK) application due to a writing error found in the decision number which was the object of the PK. Factually, the original Decision cited the year of the Decision as 2022 when it should have been 2023. This seemingly minor mistake in the year inscription rendered the decision, which was supposed to be final and binding (inkracht), administratively flawed in the eyes of the highest judicial institution.
Resolution Through Fast-Track Examination Under Article 66
The resolution to this issue was facilitated by the Panel of Judges, who correctly applied the provisions of Article 66 paragraph (1) letter c of the Tax Court Law. This Article grants the Tax Court the authority to conduct a fast-track examination to correct writing errors and/or calculation errors. During the Panel's deliberation, the writing error on Page 1 of the original Decision was clearly proven and did not require a response from the Respondent (DJP). The Panel decided to Grant the Correction Request in Full and stipulated that this Correction Decision is an inseparable part of the original Tax Court Decision Number PUT-000646.16/2023/PP/MXIVB Tahun 2024.
