This dispute originated when PT DSN received a Tax Collection Letter (STP) regarding administrative sanctions under Article 14 Paragraph (4) of the KUP Law for the alleged late issuance of Tax Invoices for the May 2014 tax period. Although the Plaintiff filed for the cancellation of an incorrect tax assessment through the mechanism of Article 36 Paragraph (1) Letter c of the KUP Law, the Directorate General of Taxation (DGT), via KEP-03582/NKEB/WPJ.06/2018, maintained the sanctions. The core legal conflict lies in the differing interpretations of the timing of VAT accrual and the validity of the administrative evidence used by the Defendant to establish mass delays without adequate transaction-by-transaction details.
The Defendant argued that based on administrative research, there were discrepancies between the delivery dates of Taxable Goods or Services and the dates of the Tax Invoices issued by the Plaintiff. In contrast, the Plaintiff strictly denied any delays and submitted evidence such as invoices, purchase orders, and shipping documents showing that Tax Invoices were issued precisely at the time of delivery or payment, as mandated by Article 13 Paragraph (1a) of the VAT Law.
In its legal consideration, the Board of Judges emphasized that the tax authority cannot rely solely on administrative assumptions without specifying which invoices were deemed late. After conducting an in-depth evidentiary review of the Plaintiff's transaction documents, the Court found that all deliveries were followed by timely Tax Invoice issuance. Consequently, the Board of Judges decided to grant the Plaintiff's lawsuit in its entirety and canceled the Defendant's decision because the imposed sanctions lacked a strong legal and factual basis.
This decision provides a significant implication for Taxpayers that the Article 36 Paragraph (1) Letter c KUP mechanism is an effective litigation path to correct material errors in an STP.
