Legal certainty regarding formal requirements for filing an Appeal is a determinant in tax disputes, particularly concerning the implementation of Article 27 Paragraph (5) of the General Provisions and Tax Procedures Law (KUP Law). This decision confirms the exemption from the obligation to pay 50% of the tax due for assessments resulting from the follow-up to a preliminary evidence examination, which served as the basis for the Panel of Judges to accept the appeal filed by PT KIDI. This case study highlights how the origin of the issuance of a Underpaid Tax Assessment Letter (SKPKB) can significantly alter the rights and obligations of the Taxpayer in pursuing legal remedies.
The case centered on a Corporate Income Tax (CIT) dispute for the 2019 Tax Year originating from a tax authority correction, but the core of the legal conflict shifted to procedural formalities. The Directorate General of Taxes (DGT), as the Respondent, relied on the general provision of Article 27 Paragraph (3) of the KUP Law, which requires the Taxpayer to pay 50% of the amount of tax still payable before filing an appeal. This argument aimed to have the appeal declared inadmissible (niet ontvankelijke verklaard). However, the Appellant presented a solid rebuttal. They underscored the key fact that the disputed SKPKB was a legal product resulting from a follow-up to a Preliminary Evidence Examination, not a routine audit.
The Tax Court Panel of Judges verified the chronology of the SKPKB issuance. After establishing that the assessment originated from a Preliminary Evidence Examination, the Panel referred to Article 27 Paragraph (5) of the KUP Law. This Article explicitly states that the 50% payment provision does not apply to appeals against Tax Assessment Letters (SKP) issued based on the results of a preliminary evidence examination or investigation. This affirmation proved that the Appellant had met the formal requirements for filing an appeal. The Panel then proceeded to examine the substantive merits of the CIT dispute. Based on the evidence and arguments presented by the Appellant, the Panel of Judges concluded that the corrections made by the Respondent were not supported by adequate legal and factual grounds.
