This dispute originated from the issuance of a Tax Underpayment Assessment Letter (SKPKB) for Income Tax to CV PM, which included interest administrative sanctions under Article 13 paragraph (2) of the KUP Law amounting to IDR 735,567,072.00. The core of this legal conflict centered on the interpretation of "the Taxpayer's oversight or not due to their fault." CV PM argued that the difference in accounting principles between the auditor and the company constituted an unintentional oversight. However, the Directorate General of Taxes (DGT) maintained its stance that the sanction was an automatic legal consequence of the underpaid principal tax based on audit results that had acquired permanent legal force because no timely material objection was filed.

The Panel found no extraordinary "oversight" that could void the obligation of said sanctions, thus deciding to reject the Plaintiff's lawsuit.
