VAT Base (DPP) corrections involving billions of rupiah based on account receivable flow analysis and alleged mining service delivery often become crucial points in tax litigation. In the case of PT SBB, the Respondent applied indirect audit techniques through yield analysis and receivable flow to establish unreported deliveries, while reclassifying mining operational costs as taxable services provided to a third party. However, Article 12 paragraph (3) of the KUP Law emphasizes that corrections must be based on strong and competent evidence, not merely mathematical assumptions derived from averaging annual values into monthly periods.

The Receivable Discrepancy and Cost Reclassification Conflict

The conflict centered on the Respondent's finding of a Rp49 billion discrepancy in the receivable flow test and the classification of PT SBB's mining costs as "services" rendered to PT PLP (the IUP holder) worth Rp31 billion. PT SBB countered by arguing that the receivable discrepancy included non-VAT transactions such as loan interest and salary reimbursements. Regarding mining services, PT SBB asserted that these costs were internal expenses incurred to secure the right to purchase materials at a fixed price, meaning no services were billed or delivered to the IUP holder.

Judicial Evaluation and Material Truth

The Board of Judges provided a resolution rooted in material truth. The Judges opined that the Respondent failed to prove the concrete legal event of taxable Goods/Services delivery, as no invoices or contracts supported the allegation. Regarding mining costs, the Board remained consistent with a previous Corporate Income Tax ruling which recognized these costs as PT SBB's expenses, not service income. This decision confirms that the flat-rate method and receivable flow tests cannot be upheld if the Taxpayer can prove the existence of non-taxable objects within the cash flow.

Industry Implications and Reconciliation Importance

The implications are significant for the extractive and construction industries. This ruling serves as a precedent that the DGT cannot unilaterally reclassify expenses as service deliveries without clear source documents. For Taxpayers, this victory highlights the critical nature of detailed reconciliation between financial statements, receivables, and VAT reporting to dismantle indirect audit assumptions.

The Board of Judges canceled the entire VAT Base correction as the Respondent failed to provide concrete evidence of delivery. Documentation compliance regarding non-VAT transactions in receivable flows was the key to success in this dispute.
