The dispute over the recognition of operational expenses has once again become a central issue in the tax court proceedings involving PT TKS. The core of the conflict began when the tax authorities disqualified several operational expenses on the grounds of non-compliance with Article 6 paragraph (1) of the Income Tax Law, which requires a direct link between the expenses and the efforts to obtain, collect, and maintain income. The respondent (DJP) argued that the evidence presented during the audit was insufficient to prove such a functional relationship.
However, during the Tax Court proceedings, the Petitioner successfully dissected the Respondent's arguments by presenting substantial evidence showing that these expenses were real and reasonable business costs. In its legal consideration, the Board of Judges emphasized the importance of material truth over mere administrative formalities. The legal resolution stated that as long as the expenses actually occurred for business purposes, the right to deduct them from gross income cannot be revoked.
The implication of this ruling reinforces that Taxpayers must maintain a robust documentation system to defend every expense item. This decision serves as an important precedent that a rigid approach in auditing 3M expenses can be overturned if the Taxpayer is able to transparently demonstrate the economic substance of transactions before the Board of Judges.
