The dispute between PT MI and the Directorate General of Taxes (DGT) reveals procedural complexities regarding the refund of tax overpayments not due under PMK 187/2015. This case began when the Taxpayer paid Article 29 Income Tax following a tax return amendment that showed an underpayment, only to later discover unrecorded tax credits that turned the final status into an Overpayment (LB). The conflict arose when the refund request for those funds was rejected by the tax authority due to an ongoing audit on the Overpaid Tax Return.
PT MI maintained that the Article 29 payment of USD 189.948 was their right and should be immediately refunded because, technically, it could not be credited within the Overpaid Tax Return form. However, the DGT argued that the certainty of such tax value must be verified through a comprehensive field audit rather than a mere administrative research. The tax authority emphasized that the payment would not be lost but would be accounted for in the final audit results as a reduction of underpayment or an addition to the overpayment value.
The Tax Court Judges ultimately strengthened the tax authority's audit prerogative. The Judges opined that to determine whether a tax is truly "not due," a verification of all tax calculation components is required, including the validity of the claimed Article 22 and 23 tax credits. Since the audit process was underway, the Court deemed the DGT's step to accommodate the payment within the audit report as appropriate for legal certainty and to avoid double refunds.
This decision provides a crucial lesson for multinational companies on the importance of accuracy in amending tax returns. Failing to identify tax credits before paying Article 29 tax can result in corporate liquidity being tied up for a long period, as it must follow the tax audit cycle which can take up to 12 months. Taxpayers are advised to be more proactive in reconciling financial data before making tax payments to the state treasury.
