Juridically, the Taxpayer positioned this transaction under Article 7 of the DTAA (Business Profits), where the taxing right resides in the recipient's country of residence as long as there is no Permanent Establishment (PE) in Indonesia.

The Tax Court Bench provided a resolution by conducting a thorough examination of material evidence. Based on the Intercompany Cost Allocation Agreement, debit notes, and reinforced by an independent audit report from a public accounting firm in Germany, the Bench found that the amounts billed corresponded to the actual costs incurred by L AG without additional profit. The Bench opined that as long as administrative requirements such as the DGT Form are met and no PE is proven, the provisions of Article 7 of the DTAA must be upheld, meaning Indonesia has no taxing rights.
