PT NMI VAT Dispute: Validity of Equalization Correction and Verification of Timing Differences

The tax dispute between PT NMI and the Directorate General of Taxes (DGT) culminated in a debate over the validity of the VAT Base (DPP) correction for the December 2019 Tax Period amounting to IDR 379,973,490. Based on regulatory data, this dispute originated from audit findings where the tax auditor performed a reconciliation between the business turnover in the Corporate Income Tax Return and the VAT Base in the VAT Returns, identifying a discrepancy considered as unreported taxable deliveries. The DGT strictly adhered to the principle that any numerical difference that cannot be detailed by the Taxpayer is automatically deemed a taxable delivery subject to VAT.

Core Conflict: Accrual Basis Accounting vs. Point of Taxation and Document Flow Verification

The core of this conflict lies in the methodological difference between the accrual basis used in financial reporting (Corporate Income Tax) and the point of taxation for VAT, which is based on the issuance of Tax Invoices. NMI argued that the discrepancy was merely a timing difference rather than new, untaxed deliveries of goods or services. NMI persistently presented concrete evidence, including general ledgers, sales invoices, and shipping documents, to prove that all transactions had their tax invoices reported, either in previous periods or the current one.

Judicial Ruling: Proof of Actual Deliveries and Cancellation of Audit Corrections

The Board of Judges, in their legal considerations, provided a crucial resolution for legal certainty. The Judges emphasized that in reconciliation disputes, the tax authority must not rely solely on mathematical discrepancies without being able to prove the actual delivery of Taxable Goods or Services. Since NMI successfully demonstrated a logical document flow and reconciliation, the Board of Judges decided to cancel the entire DGT correction. This ruling underscores that materiality and proof of document flow are far more paramount than formal, administrative reconciliation results.

This case confirms that weaknesses in the DGT's automatic reconciliation system can be refuted with organized documentation management.
