The Respondent contended that the services were delivered from PT. KKN to its main partner as a subcontractor relationship, meaning the obligation to collect VAT rested with PT. KKN.

The Judges ruled that every delivery of taxable services within the Customs Area must be subject to VAT, regardless of whether VAT at the main contract level had been collected by the treasurer.
