The Core Conflict: Selling Price Fair Market Value vs. Cargo Adjustments

The core conflict originated from the Respondent's correction of the value of taxable goods delivered to affiliates. The Respondent deemed the Petitioner's selling prices below fair market value after comparing them with external data. Consequently, the Respondent performed a secondary adjustment by increasing the Output VAT Taxable Base. The Petitioner countered, stating that price differences occurred due to cargo and quality adjustments ignored by the Respondent, while also challenging the validity of the tax assessment letter (SKPKB) signed by an Acting Official.

Judicial Consideration: Procedural Channels and Substantive Consistency

The Board of Judges, in its consideration, rejected the Petitioner's formal plea, ruling that the issue of signing authority should have been pursued through a Lawsuit (Gugatan) rather than an Appeal (Banding). Regarding the merits, the Board emphasized that since the primary correction on business turnover in the Corporate Income Tax dispute was upheld, the VAT Taxable Base correction as a secondary adjustment must legally be maintained to ensure consistency. The final verdict rejected the Petitioner's appeal in its entirety.

Critical Insight: This case highlights the "domino effect" risk. Inability to defend price fairness at the income tax level will automatically undermine the taxpayer's position regarding VAT.
