How PT SSB Successfully Challenged Rental Expense Corrections in the Tax Court.

PT SSB Final Income Tax Article 4(2) Dispute: Rental Expense Corrections and Data Extrapolation Validity

The dispute originated from the Respondent's correction of the Final Income Tax Article 4 Paragraph (2) object regarding rental expenses amounting to IDR 405,271,438, which was deemed unreported by PT SSB. The Respondent performed data extrapolation on rental costs based on audit findings without accurately considering the limitations of the expense recognition period. PT SSB filed an objection, arguing that the majority of the corrected expenses belonged to periods prior to December 2016 or were transactions that did not meet the criteria for Final Income Tax objects.

Core Conflict: Discrepancies in Extrapolated Calculations and Audit Procedural Defects

The core conflict lay in the discrepancy between the Taxpayer's internal records and the tax auditor's extrapolated calculations. PT SSB emphasized that the correct rental expense calculation was only IDR 180,804,481, whereas the Respondent insisted on IDR 586,075,919. Beyond material aspects, PT SSB highlighted procedural defects in the audit process, where the SPHP (Notification of Audit Results) was delivered beyond the 6-month timeframe stipulated by PMK 17/PMK.03/2013, which they argued should nullify the audit outcomes.

Judicial Approach and Considerations: Substantive Verification of Evidence

The Panel of Judges, in its consideration, adopted a substantial approach. Regarding procedures, the Panel ruled that administrative delays do not automatically invalidate the Director General of Taxes' authority to determine tax liability as long as the statute of limitations has not expired. However, materially, the Panel conducted a deep verification of the evidence presented during the trial. Consequently, the Panel partially granted PT SSB's appeal, as it was proven that some of the Respondent's corrections were not supported by evidence of ownership or transaction periods relevant to the disputed tax period.

Key Lessons and Implications: Synchronizing Cost Accounting and Withholding Tax Records

The implications of this decision offer a crucial lesson for Taxpayers on the importance of synchronizing cost accounting records with withholding tax supporting documents. Even if procedural formalities are breached by the authorities, the strength of material evidence in court remains the primary key to winning a dispute. This ruling confirms that material justice takes precedence in Tax Court litigation to determine the actual amount of tax due.
