How PT BWI Proven Input Tax Validity Despite Alleged Duplicate Invoices

VAT Dispute of PT BWI: Internal Approweb Data vs. Transactional Reality in Input Tax Adjustments

The Value Added Tax (VAT) dispute involving PT BWI highlights the tax authority's rigidity in adjusting Input Tax based on internal "Approweb" system data without considering transactional reality. The core conflict arose when the Respondent adjusted the Input Tax for the April 2014 period by IDR 4,301,835.00, alleging the discovery of 18 duplicate Tax Invoices, reporting discrepancies, and a lack of evidence regarding the flow of goods and funds. The Respondent asserted that under PER-24/PJ/2012, Tax Invoices inconsistent with system data are categorized as incomplete or invalid, thus non-creditable.

The Appellant's Defense: Pre-e-Faktur Constraints and the Joint and Several Liability Principle

Conversely, PT BWI as the Appellant provided an argumentative defense, stating that in 2014, the e-Faktur system had not been fully implemented, leaving buyers with no instrument to validate the serial numbers issued by sellers. The Appellant emphasized that the principle of joint and several liability under Article 33 of the KUP Law should not penalize the buyer as long as they can prove the VAT payment was made to the seller. PT BWI presented concrete evidence, including payment vouchers, original invoices, bank statements, and purchase orders, to debunk the Respondent's assumptions.

Legal Considerations of the Judges: Prioritizing Material Truth and Cash Flow Evidence Verification

The Tax Court Judges, in their legal considerations, prioritized the principle of material truth over systemic formality. Following a cross-examination of evidence, the Bench found that for the VAT value of IDR 3,525,635.00, the Appellant successfully demonstrated a flow of funds consistent with the related invoices. However, for the remaining adjustment of IDR 776,200.00, the Appellant failed to provide supporting documents; thus, that portion of the adjustment was upheld. This decision reaffirms that cash flow evidence is a crucial instrument in defending the right to credit Input Tax.

Ruling Implications: The Strength of External Evidence in Overturning Tax Authority Discrepancies

The implications of this ruling offer a vital lesson for Taxpayers: maintaining organized supporting documentation is the ultimate shield in litigation. Even if tax authorities possess internal data suggesting discrepancies, the strength of external evidence such as bank statements and transfer receipts can overturn such adjustments. This judgment reinforces the Taxpayer's position that administrative errors on the seller's side do not automatically disqualify the buyer's right to Input Tax credits, provided the transaction is genuine and paid.
