Minister of Finance Regulation Number 48 of 2023 contains provisions establishing legal definitions for taxation management in the gold and jewelry sector. These provisions serve as the primary reference for understanding the rights, obligations, and mechanisms for Income Tax (PPh) and Value Added Tax (VAT) treatment for transactions involving the transfer of gold jewelry, gold bullion, non-gold jewelry, gemstones, and related services.
This provision outlines the classification of tax subjects and business actors, from the definition of Entrepreneurs to Taxable Entrepreneurs (PKP). Based on this provision, the definition of PKP specifically includes entrepreneurs who deliver Taxable Goods and/or engage in the buying and selling of gold jewelry and the provision of related services. Furthermore, it stipulates that Taxpayers, Income Tax Withholders, and Income Tax Collectors are the parties responsible for taxation.
PMK 48/2023 also details the instruments for withholding and collecting income tax, which include Income Tax Article 21, Income Tax Article 22, and Article 23 Income Tax. Income Tax Article 21 regulates withholding of income in connection with work, services, or activities for domestic individual Taxpayers, while Income Tax Article 22 and Income Tax Article 23 respectively target the delivery of certain goods/business activities and payment of service fees to domestic Taxpayers or permanent establishments. This provision is closely related to the appointment of Other Parties in tax collection.
Lastly, PMK 48/2023 also defines the Selling Price and Replacement Price as the monetary value, including all costs requested or expected to be requested by the seller or entrepreneur, excluding VAT and discounts on the Tax Invoice. This value limit serves as the benchmark for calculating the tax payable by gold manufacturers and traders.
