The Respondent argued that without valid proof of payment and accounting records, the transaction value cannot be verified, making the use of benchmark tariffs legally mandatory.

Although the Petitioner presented an invoice, the court examination revealed that the company's Transaction Journal lacked any entry for the payment of the disputed freight cost. This absence of post-entry in the accounting books became crucial evidence that undermined the Petitioner's argument that the cost had indeed been incurred and paid.
