The core of this conflict lies in the differing interpretations of service existence and its correlation with primary adjustments in Corporate Income Tax. The Respondent applied Article 18 paragraph (3) of the Income Tax Law, viewing the IT, legal, and R&D services received by the Petitioner as passive association that provided no specific economic benefit. Conversely, the Petitioner emphasized that without these services, company operations would be hindered due to the absence of relevant internal divisions, supported by Transfer Pricing Documentation (TP Doc) showing that the company's margins remained within the industrial arm's length range.

In its resolution, the Board of Judges provided a legal consideration that was accessory yet fundamental. Since this Article 26 Income Tax dispute was a direct consequence of the Corporate Income Tax adjustment previously decided, the Board referred to Decision Number PUT-010767.15/2023/PP/M.VB Year 2024. In that primary decision, the Board had cancelled all service fee adjustments because the Petitioner successfully proved the existence and benefit of the services through correspondence and technical reports. Consequently, the recharacterization into dividends automatically lost its legal basis.
