Tax Dispute Analysis: PT SISL and VAT Exemption Facilities on Palm Kernel Expeller (PKE) as a Strategic Commodity

Palm oil industry waste in the form of PKE frequently becomes the object of classification disputes regarding tax rates and facilities between tax authorities and business entities. The core conflict in the PT SISL case focuses on the interpretation of whether PKE is an industrial product subject to VAT or a strategic agricultural product entitled to VAT exemption facilities under applicable regulations. The Respondent (DJP) performed a positive correction of the VAT Base (DPP) on the grounds that PKE has undergone an industrial extraction process, thereby losing its natural characteristics as a primary agricultural product, which automatically revokes the right to VAT exemption facilities based on Government Regulation (PP) Number 31 of 2007.

However, the Appellant (Taxpayer) presented a strong argument by anchoring its legal position on established jurisprudence, namely the Supreme Court Decision Number 70P/HUM/2013, which annulled the restrictive articles in PP 31/2007. The Appellant emphasized that PKE is essentially waste from palm kernel processing intended as raw material for animal feed; thus, based on SE-24/PJ/2014, this commodity remains classified as a Strategic Taxable Good. The resolution from the Tax Court Judges ultimately favored the Appellant, where the Panel emphasized that as long as the commodity is used for animal feed or its raw materials, the VAT exemption facility must be granted to maintain legal certainty and fairness for the agribusiness sector. This analysis demonstrates that a deep understanding of the hierarchy of laws and high-level court decisions is crucial when facing rigid administrative corrections. In conclusion, the status of PKE as a VAT-exempt good remains firm as long as the criteria for its use as animal feed are met, and businesses are advised to ensure that documentation of goods flow is maintained to strengthen arguments in court.
