This dispute centers on the application of Article 18 paragraph (3) of the Income Tax Law and the Arm's Length Principle (ALP) regulations.

The core of the conflict lies in the validity of the 12 comparable companies selected by the Respondent via the Osiris database. The Respondent characterized PT FI as a "Limited Risk Manufacturer" and sought benchmarks based on general criteria without conducting a profound functional analysis of the specific foundry chemical industry. Conversely, PT FI countered that the Respondent's benchmarks possessed material differences in Functions, Assets, and Risks (FAR), thus failing to meet the comparability requirements stipulated under PER-32/PJ/2011.

Legal Considerations by the Board of Judges

The Board of Judges, in their legal considerations, emphasized that in transfer pricing examinations, the quality of comparability is far more critical than the quantity of benchmarks. The Court found that the benchmarks proposed by the Respondent did not reflect industrial characteristics similar to those of PT FI. After a thorough evaluation of the trial evidence and a more accurate re-analysis of comparability, the Judges were convinced that PT FI's profit profile actually remained within the arm's length range when compared to functionally comparable entities.
