The return of an application for the cancellation of a tax assessment deemed incorrect by the tax authorities is often a stumbling block for Taxpayers pursuing the administrative path of Article 36 paragraph (1) letter b of the KUP Law. In the dispute between CV LS and the Directorate General of Taxes (DGT), the Board of Judges emphasized that compliance with the hierarchy of formal procedures is absolute, where filing for a reduction in administrative sanctions (letter a) automatically closes the door for an application to cancel the assessment (letter b) for the same object.

The core of the conflict began when CV LS filed a lawsuit against the return letter issued by the DGT Regional Office. The Plaintiff argued that the VAT Underpayment Assessment (SKPKB) issued by the Head of the Tax Office was legally flawed because it was signed based on an internal mandate (KEP-206/PJ/2021) which they claimed had no external binding force. However, the Defendant (DGT) maintained that the application must be returned in accordance with Article 15 paragraph (3) of PMK Number 8/PMK.03/2013, considering the Plaintiff had previously filed for a reduction in administrative sanctions which had already been decided.

Judicial Considerations: The Validity of Signing Authority and the Prohibition of Double Applications

The Board of Judges, in its legal considerations, rejected the Plaintiff's arguments. The Judges argued that formally, the Plaintiff's application did not meet the cumulative requirements due to "double applications" on two different paths of Article 36 KUP. The Assembly emphasized that the delegation of signing authority for Tax Assessments from the Director General of Taxes to the Head of the Tax Office through a mandate mechanism is valid and constitutional to ensure the effectiveness of public services.

Strategic Implications: Risks of Sequence Errors and Exclusivity in Litigation Strategies

This decision has serious implications for tax practitioners, highlighting that litigation strategy must be carefully executed from the early stages. The choice between Article 36 paragraph (1) letter a (sanctions) and letter b (substance/cancellation) is exclusive. Errors in the filing sequence or the failure to withdraw a previous application can cause the Taxpayer's right to challenge the dispute's substance to be formally blocked before the merits of the case can be examined.

In conclusion, administrative strength in taxation relies heavily on procedural precision. Taxpayers are advised to prioritize procedural risk analysis before submitting administrative applications to avoid the return of documents that results in the loss of legal defense opportunities.
