VAT Dispute for the December 2018 Tax Period of PT SSA

The VAT dispute for the December 2018 Tax Period between PT SSA and the DGT serves as a crucial precedent regarding the limits of tax examiners' authority in performing corrections based on accounts receivable flow tests without supporting evidence of actual service delivery. The core conflict centered on the classification of credit mutations in the Miscellaneous Debt account amounting to IDR 287,265,290.00, which the Respondent deemed as unreported Consulting Services, while the Taxpayer maintained that the balance consisted of operational bailouts from the Director and proceeds from the sale of personal assets.

Juridical Analysis: Material Evidence vs. Automatic Turnover Classification

Juridically, the Respondent failed to prove the existence of a legal event of rendering Taxable Services as stipulated in Article 4 paragraph (1) letter c of the VAT Law. The Board of Judges, in their consideration, emphasized that the presence of incoming funds in a company's bank account does not automatically qualify as business turnover if the Taxpayer can prove the origin of those funds. During the trial, PT SSA successfully presented material evidence such as Petty Cash Vouchers, cash slips, and personal asset ownership documents (vehicle registration/logbooks) confirming that the funds were purely non-operational in nature.

Formal Tax Aspects, PMK 183/2015, and Dispute Resolution

The resolution of this dispute also highlighted formal tax aspects in accordance with PMK 183/2015. The Board of Judges found data inconsistencies between the SPHP, the Discussion Minutes, and the issued SKPKB. The inaccuracy in detailing corrections per tax period rendered the tax assessment letter procedurally flawed. Consequently, the Board of Judges canceled the Respondent's entire correction and granted the Taxpayer's appeal, reaffirming that material truth must be supported by formal accuracy and authentic evidence.
