VAT disputes regarding the utilization of Intangible Taxable Goods or Services from outside the customs area often become a critical point in tax audits, especially when tax authorities attempt to assert the existence of a Permanent Establishment (PE) for foreign vendors. The case involving PT EI (the Applicant) originated from the Respondent's correction of Offshore Service VAT (PPNJLN) worth billions of rupiah. The Respondent argued that the US-based vendor, should be categorized as a PE in Indonesia due to its involvement in a long-term project exceeding the time test in the Indonesia-USA Tax Treaty. Consequently, the Respondent assessed that the transaction should have utilized the domestic Tax Invoice mechanism instead of VAT collection via Tax Payment Slips (SSP), while also highlighting administrative errors in the vendor's name entry on the SSP.

The Core of This Conflict and the Material Proof of a PE's Existence

The core of this conflict centers on the material proof of a PE's existence and the limits of formality in tax documentation. The Applicant firmly denied the existence of a PE because the legal relationship was purely the leasing of equipment (compressors) without any construction or installation activities performed by the vendor in Indonesia. Furthermore, the Applicant emphasized that the 10% VAT had been collected, remitted to the state treasury, and reported; thus, the error in filling out the vendor's name on the SSP box was merely administrative and should not invalidate the right to credit the input tax.

The Board of Judges Favoring Substantial Justice in Legal Considerations

The Board of Judges, in its legal considerations, provided a resolution favoring substantial justice. The Judges stated that the Respondent failed to provide concrete evidence of activities triggering a PE as regulated in Article 5 paragraph (2) letter (i) of the Indonesia-USA Tax Treaty. Regarding the SSP formality issue, the Board opined that as long as the tax payment can be verified through cash flows and document trails, the Applicant's right to credit remains valid. This decision reaffirms that economic substance and real evidence of payment to the state treasury must prevail over minor administrative errors in document completion.

The Implications of This Ruling for Taxpayers Legal Certainty

The implications of this ruling provide legal certainty for taxpayers that as long as tax payment obligations have been fulfilled and validly proven, formal aspects cannot be used rigidly to cancel taxpayer rights.
