This case originated when the Defendant issued a Tax Collection Summons (STP) for the October 2013 Tax Period, which included administrative fines under Article 14 Paragraph (4) of the KUP Law. The tax authority made corrections after finding that the Plaintiff issued Tax Invoices with very general descriptions of Taxable Goods (BKP), specifically "Materials Used" or "Pemakaian Material," without specifying the actual type of goods delivered. The DGT argued that this non-compliance categorized the Tax Invoices as "Incomplete Tax Invoices," making the Taxable Person (PKP) liable for a penalty of 2% of the Tax Base (DPP).

Legal Conflict: Internal Supporting Documents vs. "Actual or True" Information on Invoices

The Plaintiff filed a lawsuit, claiming that the details of the goods were comprehensively available in supporting documents such as Credit Sales Minutes and Reservation Slips, which were inseparable attachments to the invoice. PT CCS referred to PER-24/PJ/2012, which allows the use of attachments if the details of the goods cannot fit onto a single invoice page. However, the Board of Judges of the Tax Court held a different legal view. In their consideration, the Judges emphasized that every Tax Invoice must include information regarding the "actual or true" delivery of BKP. Using general terms like "Materials Used" without specific details in the designated column—or without an attachment mechanism that meets formal standards at the time of issuance—was deemed a violation of the principle of legal certainty in VAT administration.

The implications of this ruling are highly significant for business entities. The Board of Judges ultimately rejected the Plaintiff's entire lawsuit and upheld the penalty in the STP. This case serves as an important precedent that internal company supporting documents do not automatically substitute for the formal obligation to fill in the description column on a Tax Invoice. For Taxpayers, precision in synchronizing the physical goods delivered with the narrative entered into the e-Faktur system is vital to avoid unnecessary administrative sanctions.
