Tax Court Decision: Symmetrical Principles of VAT Article 16D and Fixed Asset Disposals for PT KPI

The imposition of Value Added Tax (VAT) on the disposal of fixed assets, which were not originally intended for trading, is a fundamental dispute issue strictly regulated under Article 16D of the VAT Law. The appeal case involving PT KPI against the VAT Underpayment Assessment Letter (SKPKB) for the May 2019 tax period successfully proved that the Taxpayer was not liable for VAT on the disposal of company cars, based on the logical link between Article 16D and Article 9 paragraph (8) letter b of the VAT Law. The core of this dispute lies in the classification of the disposed vehicle (Nissan Serena/Livina) as a station wagon, a classification recognized by transport regulations, where the Input VAT on the acquisition of such vehicles is explicitly prohibited from being credited.

Core Conflict and the General Obligation Principle

The conflict began when the Directorate General of Taxes (DJP) corrected the Tax Base (DPP) for the fixed asset disposal, assuming that such disposal was automatically subject to VAT 16D. The DJP argued that any disposal of assets originally not intended for resale must be subject to VAT. However, the Taxpayer provided a strong rebuttal by asserting that Article 16D contains an exception: the disposal is not subject to VAT if the Input VAT paid at the time of acquisition could not be credited. According to Article 9 paragraph (8) letter b of the VAT Law, Input VAT on the acquisition of sedan and station wagon vehicles cannot be credited.

Judicial Analysis and Historical VAT Treatment Jurisprudence

The Tax Court Judges meticulously evaluated the submitted evidence, including the vehicle's technical data. The panel agreed that Article 9 paragraph (8) letter b of the VAT Law has a direct implication on Article 16D of the VAT Law. Since the Taxpayer was proven not to have credited the Input VAT upon acquisition due to the vehicle's non-primary operational nature (station wagon), then, for legal certainty, its subsequent disposal cannot be subject to VAT. This court decision upholds the principle that tax authorities cannot impose Output VAT on asset disposal if they previously prohibited the crediting of Input VAT on its acquisition. The ruling provides important jurisprudence clarity regarding the interpretation of VAT Article 16D and the Taxpayer's obligation to document the historical VAT treatment of fixed assets.
