Tax Court Decision on Input Tax Crediting and Substance Validation of PT DIA

The Tax Court has once again emphasized the importance of material proof in Input Tax (PM) disputes. In decision PUT-008795.16/2023/PP/M.IA Year 2025, the Judicial Panel granted the entire appeal of PT DIA. This decision effectively annulled the Value Added Tax (VAT) correction for the October 2018 Tax Period amounting to IDR 168,367,000.00. The main focus of this decision was the Taxpayer's ability to prove the validity of the transaction substance underlying the PM crediting.

Background of VAT SKPKB Correction and the Burden of Proof

This case began with the issuance of a VAT Underpayment Tax Assessment Letter (SKPKB) by the Director General of Taxes (Respondent). The Respondent corrected the Input Tax that had been credited by PT DIA. The Respondent's argument (simulation/inference) was based on doubts regarding the fulfillment of the transaction's material requirements. According to the provisions of Article 9 of the VAT Law, the burden of proof that a PM can be credited rests with the Taxpayer. The Respondent assessed that the Taxpayer failed to present sufficient evidence to confirm that the transactions were real and related to business activities (3M).

Appellant's Rebuttal and Comprehensive Evidentiary Presentation

The Appellant, PT DIA, strongly rejected the correction. During the litigation process at the Tax Court, the Appellant asserted that all transactions for which PM was credited were valid and genuinely occurred. To counter the Respondent's arguments, the Appellant presented a comprehensive series of supporting evidence. (Simulation/inference) This evidence was not limited to tax invoices (formal requirements) but also included material documents such as contracts, purchase orders, proof of goods/services delivery (delivery orders/BAST), and valid proof of payment via bank statements.

Judicial Panel Findings and Annulment of the Tax Assessment

The Judicial Panel IA, which made its decision in deliberation on September 11, 2024, and pronounced it on July 30, 2025, fully supported the Appellant's arguments and evidence. The Panel opined that based on the facts and evidence at trial, the Appellant had successfully and adequately proven the fulfillment of formal and material requirements for the disputed PM. The Panel assessed that the evidence submitted was sufficient to convince them that the transactions were real and directly related to business activities. Therefore, the Respondent's correction was declared to lack a strong legal basis and was annulled.

Legal Precedent and Strategic Litigation Insights for Input VAT Disputes

This decision sets an important precedent, affirming that in VAT disputes, the formal completeness of a tax invoice alone is insufficient if the DGT doubts its material substance. The Taxpayer's victory demonstrates that a litigation strategy focused on presenting a sequential and complete set of transaction evidence, from purchase orders to proof of payment, is the primary key to winning Input Tax correction disputes.
