Furthermore, the Board emphasized that the existence of loss-making comparables cannot be automatically rejected, provided the losses are driven by market conditions rather than related-party transactions. This approach aligns with the OECD Transfer Pricing Guidelines, which prioritize economic substance over formal categorization.

Resolution and Key Implications: Adjusting Interquartile Range and TP Doc Defense

The resolution of this dispute granted a partial victory to the Taxpayer. The Judges decided to accept several comparable companies previously rejected by the Respondent, which automatically adjusted the interquartile range. Consequently, the value of the COGS correction treated as a dividend decreased drastically, significantly reducing the PPh Article 26 liability. This ruling serves as a crucial reminder for multinational enterprises that robust Transfer Pricing Documentation (TP Doc) accurately reflecting Functions, Assets, and Risks (FAR) is the primary defense against transaction recharacterization by tax authorities.
