The Respondent applied a deemed interest scheme, arguing that any loan within a related party relationship must adhere to the Arm's Length Principle (ALP) pursuant to Article 18 (3) of the Income Tax Law, despite the agreement being interest-free. The Respondent utilized Bank Indonesia's consumer loan interest rates (13.15% to 13.76%) as a benchmark, assuming the funds were used for the shareholder's personal consumption.

Petitioner's Rebuttal: Redeposited Funds in Bank BCA vs. Consumer Loan Benchmark

The Petitioner firmly contested the use of consumer loan rates. The Petitioner's primary argument was that the loan funds were, in fact, redeposited by the shareholder into Bank BCA under a personal name to ensure the funds remained readily available for the company's operational needs. The Petitioner argued that if interest were to be imputed, the most reasonable and comparable rate would be the Bank BCA deposit rate of 6.25%, rather than a consumer loan rate which carries a significantly different risk profile.
