The Substance Over Form Doctrine on Vendor NSFP Allocation Errors: PT BJ Input VAT Dispute

Input VAT credit disputes frequently become a major hurdle for taxpayers, particularly when the Directorate General of Taxes (DGT) imposes sanctions for administrative errors committed by third parties. In the case of PT BJ, the Respondent corrected the Input VAT on the grounds that the Tax Invoices received were issued using Serial Numbers (NSFP) outside the allocated range and predated the NSFP notification letter. The Respondent insisted that based on Article 13 paragraphs (5) and (9) of the VAT Law jo. PER-24/PJ/2012, such invoices are categorized as incomplete Tax Invoices that cannot be credited, further emphasizing that the seller's administrative risk is a civil responsibility of the buyer.

The Petitioner's Argument on Joint Liability and Material Proof

However, the Petitioner presented a robust defense by prioritizing the principle of substance over form. The Petitioner emphasized that the Value Added Tax (VAT) had been genuinely paid to the seller, as evidenced by valid cash and goods flow documentation. Referring to Article 16F of the VAT Law, the Petitioner argued that vicarious liability (tanggung jawab renteng) cannot be applied as long as the buyer can demonstrate proof of tax payment. For the Petitioner, the seller's technical error in inputting serial numbers was beyond the buyer's control and should not eliminate the constitutional right to credit the tax already paid.

The Tax Court's Position on Material Truth and Equity

The Tax Court Judges, in their deliberation, took a progressive and equitable stance. The Panel ruled that physically, the Tax Invoices met formal requirements as they included the code, serial number, and date. The error in using serial numbers outside the quota was deemed purely an administrative oversight by the Seller, which was impossible for the buyer to detect or control at the time of the transaction. With the verification of goods and cash flows, the Panel concluded that the right to credit Input VAT must be upheld to prevent double taxation and injustice against compliant Taxpayers.

Legal Implications and Precedent for Compliant Taxpayers

This decision has significant implications for tax practices in Indonesia, specifically in reaffirming that unilateral administrative errors by the seller do not automatically void the buyer's rights. For Taxpayers, this ruling serves as a strong precedent to defend credit rights as long as material transaction evidence is fully available. In conclusion, legal justice must transcend administrative rigidity, especially when the Taxpayer has tangibly fulfilled their tax payment obligations.
