Tax Court Decision on Withholding Tax Article 23 Credit Dispute of PT SI
The administrative requirements for tax withholding and crediting of income tax have become the central issue in the tax dispute involving PT SI. In Decision Number PUT-007622.15/2023/PP/M.XIIIB Year 2025, the Tax Court Panel partially granted the appeal filed by the Taxpayer concerning the correction of Withholding Income Tax Article 23 (PPh 23) credit which was denied by the Respondent, the Directorate General of Taxes (DGT). This dispute highlights the critical importance of both formal and material compliance on a cumulative basis in recognizing tax credits, a crucial aspect in the Corporate Income Tax (CIT) Annual Tax Return (SPT).

Conversely, PT SI strongly refuted the correction, asserting that the disputed PPh 23 originated from real service transactions. The Appellant contended that it possessed the withholding slips and that the withheld PPh had been substantively deposited into the state treasury. The Appellant emphasized that the material truth should take precedence, and efforts were made to complete the documentation throughout the legal process.

The Tax Court Panel provided a resolution by conducting an evidence review on a case-by-case basis to test the validity of each corrected item. In its legal consideration, the Panel acknowledged that tax credits must meet two cumulative requirements: formal (a valid withholding slip) and material (existence of the object, correct withholding, and proper deposit). After examining the evidence, the Panel was convinced that part of the DGT's PPh 23 correction must be revoked because it was supported by valid withholding slips. However, the remaining part of the correction was upheld as the formal validity of the documents remained questionable.
