This dispute centers on determining the timing of Income Tax Article 23 (PPh 23) liability regarding expenses recorded on an accrual basis in the Taxpayer's books without actual payment or legal fund availability. The core conflict arose when the Respondent issued a positive correction to the PPh 23 Tax Base for November 2016 based on General Ledger expense accounts, arguing that accounting recognition automatically triggers tax withholding obligations under the "available for payment" doctrine. However, PT TR (the Petitioner) argumentatively countered that accruals are merely a "matching cost against revenue" mechanism for commercial reporting and do not constitute a payment maturity date or a real provision of funds to a third party.

In Its Resolution the Board of Judges Emphasizes Distinctions From Withholding Tax Objects

In its resolution, the Board of Judges provided an enlightening legal opinion by emphasizing the distinction between accounting entries and tax legal events. The Judges opined that "available for payment" implies that funds have been allocated and are ready to be handed over to the recipient, rather than being a mere figure in an expense post. Consequently, most of the Respondent's corrections were overturned as the Petitioner successfully demonstrated that PPh 23 withholding had been compliantly executed when payments were made in subsequent tax periods. This ruling serves as a vital precedent protecting Taxpayers from automatic equalization between Profit and Loss expenses and withholding tax objects without considering transaction reality. In conclusion, systematic documentation of cash flows and withholding tax slips at the time of realization is the primary key to winning similar disputes.
