According to the Respondent, this loss indicated that transfer prices in affiliated transactions did not meet the Arm's Length Principle (ALP). On the other hand, PT NFI strongly refuted this, arguing that the loss was a logical consequence of a market penetration strategy and unavoidable global raw material price increases, rather than transfer pricing manipulation.

The Tax Court Judges, in their legal considerations, provided a resolution favoring substantial justice. The Assembly assessed that the Respondent failed to prove any invalidity in the pricing method applied by PT NFI. Furthermore, the Assembly criticized the Respondent's selection of comparable companies, which were deemed not to meet strict functional comparability criteria in accordance with OECD Guidelines.

Ruling Implications: Strengthening the Narrative within the TP Doc for Legally Acceptable Losses

The implication of this decision confirms that figures outside the arm's length range do not automatically serve as evidence of profit shifting.
